This Acceptable Use Policy (“AUP”) applies to all customers and users of the SMS Pilot platform operated by SMS Pilot LLC, a Wyoming limited liability company (“SMS Pilot,” “we,” “our”). The AUP is incorporated by reference into our Terms & Conditions; using the platform constitutes acceptance of this policy.
Who the platform is for.
SMS Pilot is built for licensed real estate professionals — wholesalers, investors, agents, and their teams — managing outbound communications with property owners, sellers, buyers, and JV partners within their own pipelines. The platform is a tool you use to operate your real estate business; you are the sender, the controller of your contact list, and the legal actor responsible for every outbound communication you direct through the service.
This AUP describes the conduct we require of every customer and what we expect you to do to keep your account in good standing.
Don’t do these things.
You may not use SMS Pilot to:
- Unconsented Contact
- Send calls, texts, RVMs, or emails to recipients from whom you have not obtained the legally required consent under applicable federal and state law (including but not limited to TCPA express written consent for autodialed or prerecorded calls and SMS, and CAN-SPAM opt-in for email marketing).
- DNC Violations
- Contact numbers listed on the federal Do-Not-Call registry, applicable state DNC registries, or your own internal DNC / opt-out list, except in compliance with an applicable exemption.
- Harassment / Fraud
- Send harassing, threatening, abusive, defamatory, or fraudulent communications, or any communication designed to defraud the recipient (phishing, malware, deceptive lead-generation pitches, etc.).
- Misrepresentation
- Misrepresent your identity, your business affiliation, your license status, or the nature of the communication.
- Illegal Content
- Send communications related to illegal goods or services, including but not limited to controlled substances, illegal firearms, prohibited financial products, or human trafficking.
- Account Sharing
- Resell, sublicense, or share your SMS Pilot access with anyone outside your organization without our written consent.
- Reverse Engineering
- Reverse engineer, copy, scrape, or attempt to derive the source code of the platform or any underlying system.
- Service Interference
- Interfere with the operation of the service, attempt unauthorized access, or use the platform to attack any other system.
- Bypass Attempts
- Bypass, attempt to bypass, or assist others in bypassing any carrier filtering, A2P registration requirements, or rate-limiting mechanisms.
What you’re responsible for.
As the sender of every communication sent through SMS Pilot, you are solely responsible for compliance with all applicable federal, state, and local laws governing outbound communications, including:
- TCPA Compliance
- Obtain and retain express written consent before placing autodialed or prerecorded calls and before sending marketing SMS. Honor opt-out and STOP requests promptly.
- A2P 10DLC Registration
- Complete brand and campaign registration through Twilio or the registry of record before sending application-to-person SMS traffic. Carrier approval is controlled by the carriers and registries, not by SMS Pilot. We may help facilitate; we do not approve or guarantee approval.
- Opt-In Records
- Maintain accurate, time-stamped records of how, when, and through what channel each recipient consented to receive communications from you. You bear the burden of proof in any dispute or regulatory inquiry.
- DNC Scrubbing
- Scrub your contact lists against the federal Do-Not-Call registry, applicable state DNC registries, and your own internal opt-out list before initiating outbound campaigns.
- STIR/SHAKEN & TRACED Act
- Ensure your outbound calling complies with caller-ID authentication and anti-robocall requirements applicable to your call profile.
- CAN-SPAM
- Use accurate sender identification, provide a clear unsubscribe mechanism in every commercial email, and honor unsubscribe requests within 10 business days.
- State Statutes
- Comply with state-level telemarketing, SMS marketing, consent, and DNC statutes that apply to recipients in the states where you operate.
SMS Pilot provides the platform. You direct who is contacted, on what terms, with what consent. We do not verify your consent records, scrub your lists for you, validate your A2P registration status, or audit your compliance posture. You are responsible for all of those obligations.
What happens if you violate this AUP.
We may suspend or terminate your account, without refund and without prior notice, if we determine in our reasonable discretion that you have violated this AUP, violated our Terms & Conditions, engaged in fraudulent or unlawful conduct, or used the platform in a manner that creates legal, regulatory, financial, or reputational risk for SMS Pilot or our other customers.
Depending on the severity of the violation, we may also take one or more of the following actions: issue a written warning, require you to remediate the issue and provide proof of remediation, suspend specific features (such as outbound SMS or autodialed calling), revoke API access, report the conduct to the relevant carriers, registries, or regulatory authorities, and cooperate with law-enforcement requests.
Any violations, fines, penalties, complaints, or legal actions arising from your outbound communications — including but not limited to TCPA, A2P 10DLC, CAN-SPAM, state DNC, or telemarketing claims — are your sole responsibility. SMS Pilot is not liable for your compliance decisions or for communications you direct through the platform. This is covered in detail in section 07 of our Terms & Conditions and section 14 (Indemnification).
If you see something, tell us.
If you believe another SMS Pilot customer is violating this AUP — sending unsolicited messages, engaging in fraud, harassing recipients, or otherwise misusing the platform — report it to us at info@sms-pilot.com. Include as much detail as you can: phone numbers, message content, timestamps, and any evidence of the violation. We will review every report we receive and take appropriate action when warranted.
If you are a recipient of a communication sent through SMS Pilot and you believe the sender violated TCPA, DNC, or other applicable law, you may report the communication to the same address. We will review and, where appropriate, suspend or terminate the sender’s account. We are not a party to the communications you receive; the sender is the legal actor and the appropriate respondent to your concern.
Updates and notice.
We may update this AUP from time to time as carrier rules, regulatory requirements, or our platform evolves. Material changes will be posted here with an updated effective date. Your continued use of the service after changes become effective constitutes acceptance of the updated AUP.
