Two categories of personal information.

From you directly. When you book a demo, sign up for a subscription, or contact us, we collect your name, email address, and phone number. When you subscribe, you also provide payment information — but we do not see or store payment card details. Those are handled entirely by Polar and Stripe.

Automatically through your visit. Standard web data: IP address, device type, browser, pages viewed, and time spent. This is collected through cookies and similar technologies described in section 06.

We do not knowingly collect data from anyone under 18. SMS Pilot is a business-to-business product and is not directed at minors.

Operating the service.

We use your information to operate the service: deliver and support your SMS Pilot CRM environment, process your subscription, respond to your inquiries, and send you account and billing notices. We may also send marketing emails — you can unsubscribe at any time by clicking the link in any email.

We do not sell your personal information.

Mobile information will not be shared with third parties for marketing/promotional purposes.

These providers process your information only to deliver their service to us. Each maintains its own privacy practices, which apply alongside this policy.

Your data, your responsibility.

When you use the SMS Pilot CRM to manage your own seller leads — uploading contact lists, recording calls, sending texts and emails — that data is processed through GoHighLevel under our configuration. You retain ownership of that data. We access it only to deliver, maintain, and improve the service, and to provide support when you ask for it.

You are responsible for the lawful collection and use of any seller data you bring into the platform, including obtaining all required consents from the people you contact.

You direct, we deliver.

The SMS Pilot service includes outbound communications on your behalf — calls, SMS, RVM, and email — to sellers in markets you select.

Compliance with applicable telephone, messaging, and email laws — including the TCPA, state-level consent and DNC requirements, A2P 10DLC registration, and CAN-SPAM — is your responsibility as the sender. SMS Pilot provides the platform; you direct who gets contacted and on what terms. Section 07 of our Terms & Conditions covers this in detail.

Site functionality and analytics.

We use cookies for site functionality, analytics, and to remember your preferences. You can disable cookies in your browser, though some site features may not work correctly if you do.

Only as long as we need it.

We keep your information only as long as we need it. Active account data is retained while your subscription is active and for a reasonable period afterward to handle disputes, comply with tax and legal obligations, and complete your data export. Billing records are retained as required by law.

Reasonable measures.

We use reasonable technical and organizational measures to protect your information, including encrypted connections, restricted access controls, and the security headers documented in our deployment configuration. No system can be guaranteed secure; if you believe your account has been compromised, contact us right away.

Access, correction, deletion.

You can request access to, correction of, or deletion of your personal information at any time. You can also opt out of marketing communications. To make a request, reach us through the contact channels on our contact page.

If you are a California resident, the California Consumer Privacy Act gives you additional rights, including the right to know what we collect about you, the right to deletion, and the right not to be discriminated against for exercising your rights. We do not sell personal information.

U.S.-based service.

SMS Pilot is operated from the United States. If you access our service from outside the U.S., your information will be transferred to and processed in the United States.

External sites.

Our site may link to third-party websites or services. We are not responsible for the privacy practices of those external sites.

Updates and notice.

We may update this policy from time to time. Material changes will be posted here with a new effective date. Continued use of the service after changes are posted means you accept the updated policy.

Software, not a brokerage.

SMS Pilot provides an Acquisition & Dispositions CRM built for real estate wholesalers and investors: AI-powered lead scoring, automated follow-ups via call, text, email, and RVM, deal pipeline management, comps on arrival, lead qualification, and related tools.

We are not a real estate broker, lender, or licensed representative. We provide software and automation tools. You remain solely responsible for the real estate transactions you pursue using the platform.

Who can use SMS Pilot.

You must be at least 18 years old, legally able to enter binding contracts, and operating a U.S.-based real estate business to use SMS Pilot. By using the service, you confirm that you meet these requirements.

Monthly subscription with one-time setup.

Add-on power-ups (iMessage Integration, Cut SMS Cost, Triple-Line Dialer) are available at additional cost.

Subscriptions are billed monthly in advance through Polar and Stripe, our payment processors. By subscribing, you authorize us to charge your payment method for each billing cycle until you cancel.

We may adjust pricing on future billing cycles with at least 30 days’ notice. Your enrolled rate stays in effect through the notice period.

Retry, suspension, termination.

If a payment fails, we may attempt to recharge your payment method within a reasonable retry window. If payment is not received within 7 days of the due date, we may suspend access to the service until your account is current. Continued non-payment may result in termination under section 11.

All sales are final.

All sales are final. We do not provide refunds, partial refunds, or pro-rated credits for setup fees, monthly subscriptions, add-ons, or unused service time, except in our sole discretion and only as agreed in writing.

You may cancel a month-to-month subscription at any time. Cancellation takes effect at the end of the current billing cycle. You retain access to the service through the end of that cycle.

What’s on you.

You agree to use SMS Pilot only for lawful purposes and in compliance with all applicable federal, state, and local laws. You are responsible for:

You direct, you comply.

This is critical. SMS Pilot enables you to make outbound calls and send SMS, RVM, and email to property owners and sellers you select. The platform is the tool; you are the sender.

You are solely responsible for compliance with all applicable communications laws, including but not limited to the TCPA, TRACED Act and STIR/SHAKEN, A2P 10DLC brand and campaign registration, CAN-SPAM, federal and state Do-Not-Call list scrubbing, express written consent and opt-in, honoring opt-out and STOP requests promptly, and state-level telemarketing and SMS marketing statutes.

Standard message and data rates may apply to recipients of communications sent via the SMS Pilot service (Msg & data rates may apply). You are responsible for disclosing this to recipients in your opt-in language and message content where required.

Don’t do these things.

You agree not to use SMS Pilot to violate any applicable law or third-party rights, send harassing, threatening, or fraudulent communications, misrepresent your identity or affiliation, resell, sublicense, or share your access with anyone outside your organization without our written consent, reverse engineer, copy, or attempt to derive the source code of our software or the underlying platform, or interfere with the operation of the service or attempt unauthorized access.

We may suspend or terminate your account immediately for violations of this section.

What’s ours, what’s yours.

We own SMS Pilot and the systems that power it. You may not copy, reproduce, modify, or distribute any part of the service except as expressly allowed in these Terms.

You retain ownership of the data you upload to the platform (seller lists, call recordings, notes, and so on). By using the service, you grant us the rights necessary to host, process, and display that data on your behalf and to use anonymized, aggregated data to improve our systems.

Outcomes depend on you.

We do not guarantee that you will close any specific number of deals, achieve any revenue level, or that any lead delivered to your CRM will result in a transaction. Real estate investing involves risk. Your results depend on your effort, market conditions, and execution. Any case studies or income examples shown in our marketing represent specific past results and are not guarantees of your outcome.

Ending the relationship.

You may cancel your subscription at any time as described in section 05.

We may suspend or terminate your access without refund if you violate these Terms, fail to pay, engage in fraudulent or unlawful conduct, or use the platform in a way that creates legal risk for us or our other customers.

Upon termination, your access to the platform ends. You will have 30 days to export your CRM data before it is permanently deleted.

As-is, as-available.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL BE FREE FROM ERRORS, DELAYS, OR DOWNTIME.

What we cap.

To the maximum extent allowed by law, SMS Pilot’s total liability to you for any claim related to these Terms or the service is limited to the amount you paid us in the three months immediately before the claim arose.

We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, lost business opportunities, or communications-law fines or penalties — even if we have been advised of the possibility of such damages.

Defending each other.

You agree to defend, indemnify, and hold harmless SMS Pilot LLC, its members, officers, contractors, and affiliates from any claims, damages, fines, penalties, or expenses (including reasonable attorneys’ fees) arising from: your use of the service, your real estate transactions, your outbound communications and any related TCPA, A2P, or telemarketing claims, your violation of these Terms, or your violation of third-party rights.

How we settle disagreements.

Please read this section carefully. It affects your legal rights.

Informal first. If you have a dispute with us, contact us first and we will try to resolve it informally within 30 days.

Binding arbitration. If informal resolution fails, any dispute arising out of or relating to these Terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration will take place in Wyoming, or by video at your election. The arbitrator’s decision is final and binding.

Class action waiver. You and SMS Pilot agree that disputes will be brought only on an individual basis. You may not participate in any class, collective, or representative action against us. The arbitrator may not consolidate more than one person’s claims.

Exceptions. Either party may seek emergency injunctive relief in court to protect intellectual property rights or confidential information without first going through arbitration.

Wyoming governs.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles. Subject to the arbitration clause above, the exclusive venue for any matter not subject to arbitration is the state and federal courts located in Wyoming.

Updates and notice.

We may update these Terms from time to time. Material changes will be posted here with an updated effective date and notified to active customers by email. Your continued use of the service after changes become effective constitutes acceptance.

The fine print on the fine print.

These Terms are the entire agreement between you and SMS Pilot regarding the service and supersede prior agreements. If any provision is found unenforceable, the rest of these Terms continue in full force. Our failure to enforce a provision is not a waiver of our right to enforce it later. You may not assign these Terms without our consent; we may assign them in connection with a corporate transaction.
